Every effort will be made to ensure your safety at Kondition Haus Facility (the “Facility”). However, there are risks inherent in the use of the Facility and/or any fitness/wellness activity, including heart stress and musculoskeletal injuries. A physician’s examination is recommended for all participants with any exercise restriction, for all men aged 45 and older, and all women 55 and older. By your voluntary participation in these activities, you agree as follows:

a. Declare yourself to be physically sound and suffer from no condition or impairment that would prevent my participation in any Facility activity;

b. Acknowledge that I have either had a physical examination or been given a physician’s permission to participate in activities at the Facility, or decided to participate without the approval of a physician;

c. Assume all risks involved and accept sole responsibility for any personal injury, damage to, or loss of property which results in my participation in and use of the Facility;

d. Release, indemnify, and hold harmless Kondition Haus, Schneider Fitness and Sports Performance, L.L.C., its members, agents, representatives, heirs, successors, and assigns from any and all claims, demands, rights of action, present or future, arising out of or relating to my use of the Facility, any activity occurring therein, to the fullest extent permitted by law; and

e. Waive any right or claim that I or my successors may have to bring a legal action, assert a claim or demand against Kondition Haus, Schneider Fitness and Sports Performance, L.L.C., its members, agents, representatives, heirs, successors, and assigns for any loss, damage, or injury sustained.
